The "Regulations on Forest and Grassland Fire Prevention and Extinguishing" were adopted at the 71st Executive Meeting of the State Council on October 31, 2025, are hereby promulgated, and shall come into force on January 1, 2026.

Article 1 These Regulations are formulated for the purpose of effectively preventing and extinguishing forest and grassland fires, safeguarding the safety of people's lives and property, protecting forest and grassland resources, and maintaining ecological security.
Article 2 These Regulations shall apply to the prevention, extinguishing and post-disaster disposal of forest and grassland fires within the territory of the People's Republic of China. The work of forest and grassland fire prevention and extinguishing in urban urban areas shall be carried out in accordance with the relevant provisions of the state.
Article 3 The work of forest and grassland fire prevention and extinguishing shall implement the guidelines, policies, decisions and arrangements of the Party and the state.
The work of forest and grassland fire prevention and extinguishing shall adhere to the work policy of "prevention first, active elimination, life first, safety first", and the principles of coordinated linkage, hierarchical responsibility, territorial-based management, scientific extinguishing, rapid response, safety and high efficiency.
Article 4 The National Forest and Grassland Fire Prevention and Extinguishing Command Headquarters shall be responsible for organizing, coordinating, guiding and supervising the national forest and grassland fire prevention and extinguishing work, and the daily work shall be undertaken by the Emergency Management Department of the State Council.
Local people's governments at or above the county level may establish forest and grassland fire prevention and extinguishing command organs (mechanisms) according to actual needs, which shall be responsible for organizing, coordinating, guiding and supervising the forest and grassland fire prevention and extinguishing work within their administrative regions, and the daily work shall be undertaken by the emergency management department of the people's government at the same level.
Article 5 People's governments at or above the county level shall organize and lead emergency management, forestry and grassland, public security, fire and rescue departments and other departments to closely cooperate in the work of forest and grassland fire prevention and extinguishing in accordance with their division of responsibilities.
Other relevant departments of people's governments at or above the county level shall be responsible for the corresponding forest and grassland fire prevention and extinguishing work in accordance with their division of responsibilities.
Article 6 Local people's governments at all levels shall be responsible for the forest and grassland fire prevention and extinguishing work within their administrative regions, and implement the administrative chief responsibility system of local people's governments.
Article 7 Where the work of forest and grassland fire prevention and extinguishing involves more than two administrative regions, the relevant local people's governments shall determine joint defense areas, formulate joint defense systems and establish joint defense mechanisms.
Article 8 Local people's governments at or above the county level shall incorporate the construction of forest and grassland fire prevention and extinguishing infrastructure into the relevant plans for national economic and social development, and incorporate the funds for forest and grassland fire prevention and extinguishing into the budget at the same level.
Article 9 The state encourages and supports scientific research, technological innovation and equipment research and development in forest and grassland fire prevention and extinguishing, strengthens the training of talents in forest and grassland fire prevention and extinguishing, popularizes and applies advanced science and technology and equipment, formulates and improves standards for forest and grassland fire prevention and extinguishing, and improves the level of science and technology, equipment and standardization of forest and grassland fire prevention and extinguishing as well as the monitoring and early warning capacity.
Article 10 Relevant departments of the State Council and local people's governments at or above the county level shall improve the informatization and intellectualization level of forest and grassland fire prevention and extinguishing work, integrate and improve systems such as fire monitoring and early warning, prevention and management, and command and communication, and realize information sharing and interconnection through in-depth application of information technology.
Article 11 People's governments at all levels and their relevant departments shall strengthen the publicity and education on forest and grassland fire prevention and extinguishing, organize regular publicity activities on forest and grassland fire prevention and extinguishing, popularize knowledge on forest and grassland fire prevention and extinguishing, improve citizens' awareness of forest and grassland fire prevention and safety, and create a good social atmosphere for the work of forest and grassland fire prevention and extinguishing.
Article 12 The state encourages the dispersion of forest and grassland fire risks through insurance and other forms, and improves the capacity of forestry and grassland disaster prevention and mitigation as well as post-disaster recovery and reconstruction.
Article 13 Units and individuals who have made outstanding contributions to the work of forest and grassland fire prevention and extinguishing shall be commended and rewarded in accordance with the relevant provisions of the state.
Article 14 The competent department of forestry and grassland of the State Council shall formulate the classification standard for forest and grassland fire risk zoning. The competent department of forestry and grassland of a provincial people's government shall, in accordance with the classification standard for forest and grassland fire risk zoning, determine the forest and grassland fire risk zoning grade of its administrative region on a county-by-county basis, report it to the forest and grassland fire prevention and extinguishing command organ (mechanism) at the same level and the competent department of forestry and grassland of the State Council for the record, and announce it to the public in a timely manner.
Article 15 The competent department of forestry and grassland of the State Council, together with the emergency management department of the State Council and other relevant departments, shall, on the basis of fully connecting with relevant plans and in accordance with the national forest and grassland fire risk zoning grades and actual work needs, formulate a national forest and grassland fire prevention and control plan, and organize its implementation after being approved by the State Council or the department authorized by the State Council.
The competent department of forestry and grassland of a local people's government at or above the county level, together with the emergency management department at the same level and other relevant departments, shall, in accordance with the national forest and grassland fire prevention and control plan and in combination with local actual conditions, formulate a forest and grassland fire prevention and control plan for its administrative region, and organize its implementation after being approved by the people's government at the same level.
Article 16 The emergency management department of the State Council, together with the competent department of forestry and grassland of the State Council and other relevant departments, shall formulate a national forest and grassland fire emergency response plan in accordance with the relevant provisions, and report it to the State Council for approval.
The emergency management department of a local people's government at or above the county level, together with the competent department of forestry and grassland at the same level and other relevant departments, shall formulate a forest and grassland fire emergency response plan in accordance with the relevant provisions, report it to the people's government at the same level for approval, and submit it to the emergency management department of the people's government at the next higher level for the record.
County-level people's governments shall organize township-level people's governments and sub-district offices to formulate forest and grassland fire emergency disposal plans in accordance with the forest and grassland fire emergency response plans; residents' committees and villagers' committees shall assist in the emergency disposal of forest and grassland fires in accordance with the provisions of the forest and grassland fire emergency response plans and the forest and grassland fire emergency disposal plans.
People's governments at or above the county level and their relevant departments shall regularly organize drills for forest and grassland fire emergency response plans.
Article 17 A forest and grassland fire emergency response plan shall include the following contents:
(1) Main tasks;
(2) Organizational command system;
(3) Disposal forces;
(4) Early warning and information reporting;
(5) Emergency response;
(6) Comprehensive support;
(7) Post-disposal.
Article 18 National comprehensive fire and rescue teams shall undertake the work of forest and grassland fire extinguishing as well as relevant prevention work as prescribed by the state.
Local forest and grassland fire fighting teams shall be established by local people's governments at or above the county level or large-scale forest, forest tree, woodland and grassland management and operation units according to actual needs. Relevant personnel shall obtain the occupational qualifications prescribed by the state, and the specific measures shall be formulated by the emergency management department and the competent department of forestry and grassland of the State Council together with relevant departments.
Local semi-professional (part-time) forest and grassland fire fighting teams shall be established by township-level people's governments, sub-district offices and forest, forest tree, woodland and grassland management and operation units according to actual needs.
The state guides and regulates social forces to participate in the work of forest and grassland fire prevention and extinguishing in an orderly manner.
People's governments at or above the county level shall deploy forces in a timely manner in accordance with regulations to carry out forest and grassland fire prevention and extinguishing work.
Article 19 All types of forest and grassland fire prevention and extinguishing teams shall establish fire prevention and extinguishing safety systems, equip themselves with personal protective equipment in accordance with relevant standards, conduct regular training and drills, organize safety education on fire extinguishing and safety avoidance drills, establish a joint defense, joint training and joint combat mechanism, and strengthen connection and coordination.
Article 20 Units and individuals engaged in the management and operation of forests, forest trees, woodlands and grasslands shall assume the responsibility for forest and grassland fire prevention and extinguishing within their management and operation areas, establish a forest and grassland fire prevention and extinguishing responsibility system, delimit forest and grassland fire prevention and extinguishing responsibility areas, determine forest and grassland fire prevention and extinguishing responsible persons, equip themselves with forest and grassland fire prevention and extinguishing facilities and equipment, and conduct regular inspections to eliminate fire hazards in a timely manner.
Article 21 Management and operation units bearing the responsibility for forest and grassland fire prevention and extinguishing of power and communication lines as well as oil and natural gas pipelines shall take corresponding fire prevention and extinguishing measures in fire-dangerous sections and periods of forest and grassland fires, inspect and eliminate fire hazards, and organize fire prevention patrols.
Railway and highway management and operation units shall be responsible for the fire prevention and extinguishing work of woodlands and grasslands under their management and operation, and cooperate with local people's governments at or above the county level in the fire prevention and extinguishing work in fire-dangerous sections and periods along railways and highways.
Agricultural and pastoral farms, industrial and mining enterprises and institutions as well as the management and operation institutions of tourist areas and development zones shall be responsible for the forest and grassland fire prevention and extinguishing work within their management and operation areas, and cooperate with relevant units in the fire prevention and extinguishing work in surrounding areas.
Article 22 Full-time or part-time forest rangers and grassland rangers shall be responsible for patrolling forests and grasslands, promptly handle and report fires in accordance with relevant provisions, do a good job in fire prevention publicity, and assist relevant departments in investigating forest and grassland fire cases.
Article 23 Relevant departments of the State Council and local people's governments at or above the county level shall, in accordance with the relevant provisions of the state, strengthen the construction of infrastructure such as firebreaks, fire separation belts, communication base stations, emergency broadcasting, watchtowers and emergency water sources (water storage), promote the upgrading of fire prevention and extinguishing equipment, establish and improve a reserve guarantee system for forest and grassland fire prevention and extinguishing materials, and timely supplement and update fire prevention and extinguishing materials.
Article 24 The State Council and provincial people's governments shall carry out aviation fire fighting construction according to the actual needs of forest and grassland fire prevention and extinguishing, make full use of satellite remote sensing technology and existing military and civil aviation infrastructure, and establish an aviation cooperation mechanism for forest and grassland fire prevention and extinguishing involving relevant units.
Article 25 Local people's governments at or above the county level shall, in accordance with the distribution of forest and grassland resources and the occurrence rules of forest and grassland fires within their administrative regions, delimit forest and grassland fire prevention zones, stipulate forest and grassland fire prevention periods, and announce them to the public.
During the fire prevention period, local people's governments at or above the county level and their relevant departments, as well as units and individuals engaged in the management and operation of forests, forest trees, woodlands and grasslands, shall take corresponding fire prevention and emergency preparedness measures in the fire prevention zones in accordance with the forecast and early warning information of forest and grassland fire risk meteorological grades.
Article 26 For the establishment of agricultural and pastoral farms, industrial and mining enterprises and institutions, tourist areas or new development zones in fire prevention zones, the forest and grassland fire prevention and extinguishing facilities shall be planned, designed, constructed and accepted simultaneously with the construction project; for large-scale afforestation in forest areas and large-scale grass planting in natural grasslands, forest and grassland fire prevention and extinguishing facilities shall be constructed in a supporting manner at the same time. The acceptance of forest and grassland fire prevention and extinguishing facilities shall be organized by the construction unit, and they shall be put into use only after passing the acceptance. Relevant departments of local people's governments at or above the county level shall strengthen the supervision and inspection of the acceptance activities and acceptance results of the construction unit.
The acceptance standards for forest and grassland fire prevention and extinguishing facilities shall be formulated by provincial people's governments in conjunction with relevant departments.
Article 27 During the fire prevention period, outdoor use of fire is prohibited in fire prevention zones. Where outdoor use of fire is really necessary due to special circumstances such as the prevention and control of diseases, pests, rodents and freeze damage, it shall be approved by the county-level people's government, and fire prevention measures shall be taken in accordance with requirements to strictly prevent fire; where non-military live-fire exercises, blasting and other activities need to be carried out in fire prevention zones, they shall be approved by the local people's government at or above the county level, and necessary fire prevention measures shall be taken.
During the fire prevention period, if the Chinese People's Liberation Army, the Chinese People's Armed Police Force and militia organizations enter the fire prevention zones to carry out live-fire exercises, blasting and other activities, handle emergencies and perform other urgent tasks, they shall take necessary fire prevention measures in advance and notify the local people's government at or above the county level.
No one shall discard fire sources in fire prevention zones.
Article 28 During the fire prevention period, units and individuals engaged in the management and operation of forests, forest trees, woodlands and grasslands shall set up fire prevention warning and publicity signs or equipment in fire prevention zones, and inform personnel entering their management and operation areas of fire prevention precautions.
During the fire prevention period, all motor vehicles and mechanical equipment entering fire prevention zones shall be installed with fire prevention devices and equipped with fire extinguishing equipment in accordance with regulations. Mechanical equipment operating in the open air in fire prevention zones shall take fire prevention measures; operating personnel shall comply with fire prevention safety operating procedures to prevent fire.
Article 29 During the fire prevention period, the competent department of forestry and grassland of a local people's government at or above the county level and the management agency of key state-owned forest areas determined by the State Council may set up temporary fire prevention checkpoints, conduct fire prevention registration and inspection of vehicles and personnel entering fire prevention zones in light of actual conditions, and carry out targeted fire prevention and extinguishing publicity and education.
Article 30 During the fire prevention period, if high temperature, drought, strong wind and other high fire risk weather are forecasted, local people's governments at or above the county level shall delimit high forest and grassland fire risk zones and stipulate high forest and grassland fire risk periods in the fire prevention zones. During the high fire risk period, if necessary, local people's governments at or above the county level may issue an order to strictly prohibit all outdoor use of fire; the use of fire for residents' daily life that may cause forest and grassland fires shall be strictly managed.
Article 31 Entering high fire risk zones during the high fire risk period shall be approved by the local people's government at or above the county level, and activities shall be carried out in strict accordance with the approved time, place and scope, and subject to the supervision and management of the competent department of forestry and grassland of the local people's government at or above the county level and relevant departments at the same level.
Article 32 The state establishes a graded forest and grassland fire risk early warning system, which is divided into four levels: Level I, Level II, Level III and Level IV according to the urgency, development trend and possible harm degree of forest and grassland fire risks, marked with red, orange, yellow and blue respectively, with Level I being the highest level.
Emergency management departments of people's governments at or above the county level shall, together with competent forestry and grassland departments, meteorological competent authorities at the same level, etc., strengthen the research on forest and grassland fire risk monitoring and early warning technologies, strengthen fire risk monitoring and early warning by comprehensively using modern fire perception methods and multi-channel information, establish a joint consultation mechanism, and timely formulate and release forest and grassland fire risk early warning information.
Meteorological competent authorities shall strengthen the construction of the capacity for forecasting forest and grassland fire risk meteorological grades, and provide forecasting services for forest and grassland fire risk meteorological grades in accordance with the law. Radio, television, newspapers, as well as network service providers and telecommunications operators shall broadcast or publish forest and grassland fire risk meteorological grade forecasts and early warning information in a timely, accurate and free manner.
After the release of forest and grassland fire risk early warning information, local people's governments at or above the county level shall take corresponding measures in accordance with the early warning level in accordance with the law.
Article 33 Emergency management departments, competent forestry and grassland departments and other relevant departments of people's governments at or above the county level shall, in accordance with their division of responsibilities, inspect the organization construction, responsibility implementation, facility construction and other conditions of relevant units in fire prevention zones regarding forest and grassland fire prevention and extinguishing. If necessary, people's governments at or above the county level may organize relevant departments to conduct joint inspections. If forest and grassland fire hazards are found during the inspection, a forest and grassland fire hazard rectification notice shall be issued in a timely manner to order the elimination of hazards within a time limit. The inspected unit shall actively cooperate and shall not obstruct or hinder the inspection activities.
Article 34 Local people's governments at or above the county level shall announce the forest and grassland fire alarm telephone number and other alarm methods, and establish a forest and grassland fire prevention and extinguishing duty system. Anyone who discovers a forest and grassland fire shall immediately report to the police.
Units and individuals engaged in the management and operation of forests, forest trees, woodlands and grasslands shall immediately report the fire occurring in their management and operation areas to the local people's government or the forest and grassland fire prevention and extinguishing command organ (mechanism) and take effective disposal measures.
The local people's government or the forest and grassland fire prevention and extinguishing command organ (mechanism) receiving the alarm or report shall immediately send personnel to the scene to investigate and verify, take corresponding disposal measures, and report step by step to the people's government at the next higher level and the forest and grassland fire prevention and extinguishing command organ (mechanism) in accordance with relevant provisions, and may report beyond the level if necessary. If conditions permit, network direct reporting or automatic rapid reporting shall be carried out.
Article 35 In case of any of the following forest and grassland fires, the forest and grassland fire prevention and extinguishing command organ (mechanism) of the provincial people's government shall immediately report to the National Forest and Grassland Fire Prevention and Extinguishing Command Headquarters, which shall report to the State Council in accordance with regulations, and timely notify the relevant departments of the State Council and the relevant military units:
(1) Forest fires with burned forest area exceeding 100 hectares, or grassland fires with burned grassland area exceeding 5,000 hectares;
(2) Forest and grassland fires causing more than 3 deaths or more than 10 serious injuries;
(3) Forest and grassland fires threatening residential areas or important facilities;
(4) Forest and grassland fires where the fire scene is within 5 kilometers of the national border or the actual control line, and pose a threat to the forest and grassland resources of China or adjacent countries and regions;
(5) Other forest and grassland fires that need to be reported after research and judgment.
Information on forest and grassland fires reported by provincial people's governments directly to the State Council shall be copied to the National Forest and Grassland Fire Prevention and Extinguishing Command Headquarters at the same time, which shall notify relevant units in a timely manner as needed.
Article 36 After receiving a fire report, local people's governments at all levels shall immediately carry out disposal work in accordance with the emergency response plan.
The National Forest and Grassland Fire Prevention and Extinguishing Command Headquarters shall initiate emergency response in a timely manner and organize emergency disposal according to the needs of forest and grassland fire response work.
Article 37 In case of a forest and grassland fire, relevant departments and units of people's governments at or above the county level shall perform their fire fighting duties in accordance with the division of labor in the forest and grassland fire emergency response plan at the same level under the unified leadership of the people's government at the same level.
Article 38 For extinguishing forest and grassland fires, a frontline fire command headquarters shall be set up in a timely manner as needed, and the timing, level and scale of its establishment shall be determined by the local people's government at or above the county level. The frontline fire command headquarters shall be headed by a person in charge of the local people's government at or above the county level as the commander-in-chief, and a professional commander shall be appointed at the same time. All rescue forces participating in fire fighting shall accept the unified command of the frontline fire command headquarters.
On the basis of verifying the accurate location and scope of the fire as well as wind force, wind direction and fire intensity, the frontline fire command headquarters shall reasonably determine the fire fighting plan, delimit fire fighting sections, determine fire fighting responsible persons, and scientifically prevent and dispose of dangerous situations in accordance with the weather, geography and other conditions of the fire scene. When important targets and major hazard sources such as military facilities, nuclear facilities, hazardous chemicals production and storage facilities and equipment, oil and gas pipelines, and railway lines are threatened by fire, the threats shall be eliminated and scientific rescue shall be carried out under the guidance of professionals.
Article 39 For extinguishing forest and grassland fires, the masses threatened by the fire shall be rescued, evacuated and evacuated in a timely manner, and the management and safety protection of fire fighting personnel shall be well done to ensure the safety of fire fighting personnel and avoid casualties as much as possible.
For extinguishing forest and grassland fires, various forest and grassland fire prevention and extinguishing teams shall be the main force; if necessary, cadres and masses may be organized to assist in fire fighting, but personnel who have not received relevant professional training shall not be arranged to directly fight the fire, and disabled persons, pregnant women, minors and other unsuitable persons shall not be mobilized to participate in fire fighting.
Article 40 When extinguishing forest and grassland fires, the relevant local people's government shall immediately organize local forest and grassland fire fighting teams, national comprehensive fire and rescue teams and other forces to participate in fire fighting nearby.
When performing forest and grassland fire prevention and extinguishing tasks, the deployment of national comprehensive fire and rescue teams shall be carried out in accordance with relevant provisions. When national comprehensive fire and rescue teams perform forest and grassland fire fighting tasks, their highest on-site commander shall enter the frontline fire command headquarters to be responsible for professional command work and participate in decision-making and on-site command organization.
Article 41 For the need of extinguishing forest and grassland fires, people's governments at or above the county level may decide to take emergency measures such as opening firebreaks, removing obstacles, emergency water intake and local traffic control.
Article 42 The state implements a unified release system for forest and grassland fire information. Forest and grassland fire information shall be released to the public by the emergency management department of the people's government at or above the county level. Information on extraordinarily serious and major forest and grassland fires shall be released by the provincial people's government, and if necessary, by the National Forest and Grassland Fire Prevention and Extinguishing Command Headquarters or the Emergency Management Department of the State Council.
Emergency management departments of people's governments at or above the county level shall release information on forest and grassland fires and response work to the public in a timely and accurate manner through various means, and respond to social concerns. No unit or individual may fabricate or intentionally disseminate false information about forest and grassland fires and fire response.
Article 43 After the open fire of a forest and grassland fire is extinguished, the fire fighting team shall conduct a comprehensive inspection of the fire scene and clean up residual fires. The local people's government shall organize sufficient personnel to guard the fire scene, and the guarding personnel may be withdrawn only after passing the inspection and acceptance in accordance with regulations.
Article 44 People's governments at or above the county level shall establish a working mechanism, and may expropriate venues, materials, equipment, transportation tools and other things for the need of extinguishing forest and grassland fires. After the fire fighting work is completed, the expropriated things shall be returned in a timely manner, and fair and reasonable compensation shall be given in accordance with the law.
Article 45 According to the area of damaged forests and grasslands and the number of casualties, forest and grassland fires are divided into four grades: general, major, serious and extraordinarily serious.
Forest fires are divided into:
(1) General forest fires: the damaged forest area is not less than 0.067 hectares but not more than 10 hectares, or the number of deaths is not less than 1 but not more than 3, or the number of serious injuries is not less than 1 but not more than 10;
(2) Major forest fires: the damaged forest area is more than 10 hectares but not more than 100 hectares, or the number of deaths is more than 3 but not more than 10, or the number of serious injuries is more than 10 but not more than 50;
(3) Serious forest fires: the damaged forest area is more than 100 hectares but not more than 1,000 hectares, or the number of deaths is more than 10 but not more than 30, or the number of serious injuries is more than 50 but not more than 100;
(4) Extraordinarily serious forest fires: the damaged forest area is more than 1,000 hectares, or the number of deaths is more than 30, or the number of serious injuries is more than 100.
Grassland fires are divided into:
(1) General grassland fires: the damaged grassland area is not less than 10 hectares but not more than 1,000 hectares, or the number of deaths is not less than 1 but not more than 3, or the number of serious injuries is not less than 1 but not more than 10;
(2) Major grassland fires: the damaged grassland area is more than 1,000 hectares but not more than 5,000 hectares, or the number of deaths is more than 3 but not more than 10, or the number of serious injuries is more than 10 but not more than 50;
(3) Serious grassland fires: the damaged grassland area is more than 5,000 hectares but not more than 8,000 hectares, or the number of deaths is more than 10 but not more than 30, or the number of serious injuries is more than 50 but not more than 100;
(4) Extraordinarily serious grassland fires: the damaged grassland area is more than 8,000 hectares, or the number of deaths is more than 30, or the number of serious injuries is more than 100.
The term "not less than" as used in this Article includes the number itself, and "not more than" does not include the number itself.
Article 46 People's governments at or above the county level shall organize relevant departments to conduct an investigation and assessment of the causes of forest and grassland fires, damaged area and standing stock, casualties, other economic losses, ecological and environmental impacts, and emergency rescue and disposal in a timely manner, and form an investigation and assessment report. If there are responsible units and persons for the forest and grassland fire, the local people's government shall determine the responsible units and persons for the fire in accordance with the investigation and assessment report, and handle them in accordance with the law.
The investigation and assessment of forest and grassland fires shall be carried out in accordance with the relevant provisions of the state. The standards for assessing the losses of forest and grassland fires shall be formulated by the competent department of forestry and grassland of the State Council together with relevant departments.
Article 47 The grade of a forest and grassland fire shall be determined in accordance with the investigation and assessment report. Fires occurring in shrublands, sparse woodlands, young forest plantations, nursery lands and other forest lands that do not cause damage to forest trees, or the damaged forest area is less than 0.067 hectares, or the damaged grassland area is less than 10 hectares, and no deaths or serious injuries are caused shall not be counted as fires.
Forest and grassland fire prevention and extinguishing command organs (mechanisms) of local people's governments at or above the county level shall count the forest and grassland fire situation in accordance with the relevant provisions of the state, report it to the forest and grassland fire prevention and extinguishing command organ (mechanism) of the people's government at the next higher level and the statistical institution of the people's government at the same level, and timely notify the relevant departments of the people's government at the same level.
The statistical survey items and statistical survey system for forest and grassland fires shall be formulated by the Emergency Management Department of the State Council together with relevant departments in accordance with the law.
Article 48 Persons who are injured, disabled or killed due to extinguishing forest and grassland fires shall be given medical treatment, pensions and preferential treatment in accordance with the relevant provisions of the state; those who meet the conditions for being rated as martyrs shall be rated as martyrs in accordance with the relevant provisions of the state.
Persons participating in the extinguishing of forest and grassland fires shall enjoy corresponding insurance benefits such as personal insurance in accordance with the relevant provisions of the state.
Employing units shall ensure that their employees' wage treatment and welfare remain unchanged during their participation in the extinguishing of forest and grassland fires.
Article 49 The relevant subsidies and allowances for persons participating in the extinguishing of forest and grassland fires as well as other expenses incurred in extinguishing forest and grassland fires shall be paid by the responsible unit or person for the fire in accordance with the standards stipulated by the provincial people's government; if the cause of the fire is unclear, they shall be paid by the unit where the fire occurred; the above expenses may be advanced by the local people's government.
Article 50 After the occurrence of a forest and grassland fire, units and individuals engaged in the management and operation of forests, forest trees, woodlands and grasslands shall take measures such as reforestation in a timely manner to restore the forest vegetation in the burned areas and the production conditions of forestry and animal husbandry, and the local people's government shall provide necessary support for the post-disaster restoration of forest and grassland resources.
Article 51 In violation of the provisions of these Regulations, if local people's governments at all levels, emergency management departments, competent forestry and grassland departments or other relevant departments of local people's governments at or above the county level and their staff commit any of the following acts, their superior administrative organs shall order them to make corrections; if the circumstances are serious, the leading personnel and directly responsible personnel who are liable shall be given sanctions in accordance with the law:
(1) Failing to formulate forest and grassland fire emergency response plans in accordance with relevant provisions, or failing to regularly organize drills for forest and grassland fire emergency response plans;
(2) Failing to issue forest and grassland fire hazard rectification notices in a timely manner when discovering forest and grassland fire hazards;
(3) Approving the outdoor use of fire that does not meet the requirements for forest and grassland fire prevention and extinguishing, or approving non-military live-fire exercises, blasting and other activities that do not meet the requirements for forest and grassland fire prevention and extinguishing;
(4) Concealing, falsely reporting or intentionally delaying the reporting of forest and grassland fire conditions;
(5) Failing to take corresponding measures in accordance with the law after the release of early warning information;
(6) Failing to take corresponding disposal measures in a timely manner or failing to dispose of fires effectively;
(7) Practicing fraud in the investigation and assessment of forest and grassland fires;
(8) Other acts of failing to perform duties in accordance with the law.
Article 52 In violation of the provisions of these Regulations, if a unit or individual engaged in the management and operation of forests, forest trees, woodlands and grasslands fails to perform the responsibility for forest and grassland fire prevention and extinguishing, the competent department of forestry and grassland and the emergency management department of the local people's government at or above the county level shall order it to make corrections in accordance with their division of responsibilities, impose a fine of not less than 20,000 yuan but not more than 100,000 yuan on the unit, and a fine of not less than 1,000 yuan but not more than 10,000 yuan on the individual; if it refuses to make corrections, impose a fine of not less than 50,000 yuan but not more than 200,000 yuan on the unit, and a fine of not less than 2,000 yuan but not more than 20,000 yuan on the individual.
Article 53 In violation of the provisions of these Regulations, if a relevant unit or individual in a fire prevention zone refuses to accept the inspection of forest and grassland fire prevention and extinguishing, or fails to eliminate fire hazards within the time limit after receiving a forest and grassland fire hazard rectification notice, the competent department of forestry and grassland and the emergency management department of the local people's government at or above the county level shall order it to make corrections in accordance with their division of responsibilities, impose a fine of not less than 10,000 yuan but not more than 20,000 yuan on the unit, and a fine of not less than 300 yuan but not more than 3,000 yuan on the individual.
Article 54 In violation of the provisions of these Regulations, if anyone arbitrarily uses fire outdoors in a fire prevention zone without approval during the fire prevention period, the competent department of forestry and grassland of the local people's government at or above the county level shall order it to stop the illegal act, impose a fine of not less than 20,000 yuan but not more than 100,000 yuan on the unit, and a fine of not less than 300 yuan but not more than 5,000 yuan on the individual.
Article 55 In violation of the provisions of these Regulations, if anyone carries out non-military live-fire exercises, blasting and other activities in a fire prevention zone without approval during the fire prevention period, the competent department of forestry and grassland of the local people's government at or above the county level shall order it to stop the illegal act and impose a fine of not less than 100,000 yuan but not more than 200,000 yuan.
Article 56 In violation of the provisions of these Regulations, if anyone commits any of the following acts, the competent department of forestry and grassland of the local people's government at or above the county level shall order it to make corrections, impose a fine of not less than 5,000 yuan but not more than 20,000 yuan on the unit, and a fine of not less than 300 yuan but not more than 3,000 yuan on the individual:
(1) During the fire prevention period, units and individuals engaged in the management and operation of forests, forest trees, woodlands and grasslands fail to set up fire prevention warning and publicity signs or equipment in fire prevention zones, or fail to take fire prevention measures in accordance with requirements for the approved outdoor use of fire;
(2) During the fire prevention period, motor vehicles and mechanical equipment entering fire prevention zones fail to be installed with fire prevention devices and equipped with fire extinguishing equipment in accordance with regulations;
(3) During the fire prevention period, mechanical equipment operating in the open air in fire prevention zones fails to take fire prevention measures, or the operating personnel of mechanical equipment engaged in outdoor operations fail to comply with fire prevention safety operating procedures;
(4) Vehicles and personnel entering fire prevention zones refuse to accept fire prevention registration and inspection;
(5) During the high fire risk period, anyone arbitrarily enters high fire risk zones without approval or fails to carry out activities in strict accordance with the approved time, place and scope;
(6) Discarding fire sources in fire prevention zones;
(7) Damaging forest and grassland fire prevention and extinguishing facilities and equipment;
(8) Establishing agricultural and pastoral farms, industrial and mining enterprises and institutions, setting up tourist areas, building new development zones in fire prevention zones, or carrying out large-scale afforestation in forest areas and large-scale grass planting in natural grasslands without constructing supporting forest and grassland fire prevention and extinguishing facilities at the same time, or putting newly constructed forest and grassland fire prevention and extinguishing facilities into use without passing the acceptance.
Article 57 Anyone who fabricates and disseminates false information about forest and grassland fires and fire response, or disseminates such false information knowing that it is false shall be punished in accordance with the law.
Article 58 If there are responsible units and persons for a forest and grassland fire, the competent department of forestry and grassland of the people's government at or above the county level may order them to replant trees and restore vegetation.
Article 59 In violation of the provisions of these Regulations, if the act constitutes a violation of public security administration, public security administration punishment shall be given in accordance with the law; if the act constitutes a crime, criminal liability shall be pursued in accordance with the law.
Article 60 Forest and grassland fire fighting vehicles shall enjoy the relevant policies for emergency rescue vehicles in accordance with the provisions of the state, and the verification and allocation of vehicle staffing shall be handled in accordance with the relevant provisions on special professional and technical vehicles of party and government organs.
Forest and grassland fire fighting vehicles shall be painted with logo patterns and installed with alarms and logo lamps in accordance with regulations.
Article 61 For forest and grassland fires occurring in the border areas of the People's Republic of China, the fire fighting work shall be carried out in accordance with the relevant agreements signed between the government of the People's Republic of China and the governments of relevant countries or the inter-departmental cooperation mechanisms; if there is no agreement or mechanism, it shall be handled through consultation between the government of the People's Republic of China and the governments of relevant countries.
Article 62 For the forest and grassland fire prevention and extinguishing work of military facilities and military-industrial facilities located in forest and pastoral areas, as well as the construction of forest and grassland fire prevention and extinguishing infrastructure and the allocation of facilities and equipment in military areas, if there are other provisions in military laws and regulations, such provisions shall prevail.
The Chinese People's Liberation Army, the Chinese People's Armed Police Force and militia organizations shall perform forest and grassland fire fighting tasks in accordance with the provisions of relevant laws and regulations.
Article 63 These Regulations shall come into force on January 1, 2026. The "Regulations on Forest Fire Prevention" and the "Regulations on Grassland Fire Prevention" shall be repealed at the same time.
